• Real-time SMTP verification
• Domain and MX record verification
• Email deliverability scoring and analytics

• Historical validation reports and data management

MailAnchor strives to provide accurate and reliable services, but validation results represent our best assessment based on available data. We do not guarantee 100% accuracy of validation results.

3. User Accounts and Responsibilities

When you create an account with MailAnchor, you agree to:

• Provide accurate, complete, and current information during registration
• Maintain the confidentiality of your account credentials and password
• Accept full responsibility for all activities occurring under your account
• Notify us immediately of any unauthorized use of your account
• Comply with all applicable laws and regulations
• Not use our services for any illegal or unauthorized purpose

• Resell or redistribute MailAnchor services without explicit authorization
• Use automated tools to scrape or extract data from our platform

5. Payment and Billing Terms

By providing payment information, you represent and warrant that you are authorized to use the payment method and that the information is accurate and complete. You agree to:

• Pay all fees and charges in accordance with your selected service plan
• Pay subscription fees in advance of service provision
• Allow automatic billing on your selected payment method
• Notify us immediately of any changes to payment information
• Pay any applicable taxes associated with your use of the service

Billing Cycle: Depending on your plan, you will be billed monthly, quarterly, or annually. Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date.

Cancellation and Refunds: You may cancel your subscription at any time by requesting account deletion through your account dashboard or by contacting us directly. Refunds for prepaid services are generally not provided, except as required by law. Upon cancellation, you will retain access to your account through the end of your current billing period.

Failed Payments: If a payment fails, we will attempt to process it again. If payment fails after multiple attempts, we may suspend your account until payment is resolved. You remain responsible for any fees incurred during suspension.

6. Intellectual Property Rights

MailAnchor retains all intellectual property rights related to the platform, including software, technology, documentation, and content. You are granted a limited, non-exclusive, non-transferable license to use our services in accordance with these Terms. You may not:

• Copy, modify, or create derivative works based on our services
• License, sell, rent, lease, transfer, assign, or otherwise exploit our services
• Remove or obscure any proprietary notices or labels
• Use our services to develop competing products or services

You retain all rights to your data, including email lists you submit for validation. By submitting data to our services, you grant MailAnchor a limited license to use your data solely for providing our services.

7. Data and Content Ownership

You retain ownership of all data, content, and information you submit to our services ("Your Data"). You grant MailAnchor a worldwide, non-exclusive license to access and use Your Data solely to:

• Provide validation services
• Maintain and improve our platform
• Generate analytics and reports
• Comply with legal obligations

We do not sell, share, or use Your Data for marketing purposes without explicit consent. Upon account termination, we will delete Your Data in accordance with our Privacy Policy.

8. Warranties Disclaimer

OUR SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. EXCEPT AS EXPRESSLY STATED IN THESE TERMS, WE MAKE NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that:

• Our services will be uninterrupted, error-free, or secure
• Validation results will be 100% accurate or complete
• Any defects will be corrected
• Your use of the service will result in any particular outcome

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MAILANCHOR, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE DURING THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the limitation or exclusion of liability, so some of these limitations may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless MailAnchor and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use of our services, (b) Your Data, (c) your violation of these Terms, or (d) your violation of any applicable laws or third-party rights.

11. Termination

MailAnchor may terminate or suspend your account and your right to use the service, immediately and without prior notice, for:

• Unlawful or fraudulent activity
• Abuse of our services or infrastructure
• Non-payment of fees
• Violation of applicable laws or regulations

You may terminate your account at any time by requesting account deletion through your account dashboard or by contacting us directly. Upon termination, your right to use the service ceases immediately.

Sections that by their nature should survive termination, including provisions regarding limitation of liability, indemnification, and dispute resolution, shall survive any termination of these Terms.

12. Modifications to Service and Terms

MailAnchor reserves the right to modify, suspend, or discontinue our services at any time. We will make reasonable efforts to notify you of significant changes. Your continued use of the service following modifications constitutes your acceptance of the modified terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the federal and state courts located in the jurisdiction where MailAnchor is headquartered for resolution of any disputes arising from these Terms or your use of our services.

14. Dispute Resolution

Before initiating legal proceedings, we encourage you to contact us to attempt to resolve any disputes informally. You agree to first attempt resolution through good-faith negotiation.

If informal resolution fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA), rather than in court proceedings. Each party shall bear its own costs, with arbitration fees split equally.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MailAnchor regarding your use of our services and supersede all prior and contemporaneous agreements, understandings, and negotiations.
